Action: Approved the application to increase the maximum allowed height of wall signs identifying the name or logo of a building or use in a building that exceeds six stories or 84 feet, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       Approval of the sign permits by the Department of Community Planning and Economic Development.

B.      Variance to exceed the number of signs.

Action: Approved the application for a variance to exceed the number of signs allowed by the conditional use permit, subject to the following condition:

1.       Approval of the sign permits by the Department of Community Planning and Economic Development.

C.      Variance to allow more than one sign on a building wall.

Action: The variance to allow more than one sign on a building wall as limited by the conditional use permit has been returned to the applicant.

3.       Target Field Station Mixed Use Project, 505 6th Ave N, Ward 5

The City Planning Commission adopted staff findings for the applications by United Properties.

A.      Registered Land Survey.

Action: Approved the application for a registered land survey subject to the following conditions:

1.       This RLS creates tracts that, if separately redeveloped, would not meet the requirements of the zoning and subdivision ordinances for lot area and width and the prohibition against lots with more than five sides at ground level. Approval of this RLS does not constitute approval for the separate redevelopment of any tract if such tract does not comply with applicable zoning and subdivision ordinances.

2.       This action of the Planning Commission shall be recorded with Hennepin County at or prior to such time as the signed RLS is presented for recording with Hennepin County.

The City Planning Commission adopted staff findings for the applications by NICO Properties.

A.      Rezoning.

Action: The City Planning Commission recommended that the City Council approve the application to rezone the properties located at 118 and 122 E Lake St from C2 Neighborhood Corridor Commercial District to I2 Medium Industrial District.

B.      Variance of the PO Pedestrian Oriented Overlay District standards.

Action: Approved the variance of the PO Pedestrian Oriented Overlay District standards to allow more than 40 feet of parking lot frontage along both E Lake St and Stevens Ave S, subject to the following conditions:

1.       A four-foot high decorative metal fence shall be located along the entire frontage of both E Lake St and Stevens Ave S. The applicant shall work with staff to better align the fence with the back of the sidewalk at the corner of Stevens Ave and E Lake St. 

2.       There shall be at least two trees planted along E Lake St and at least ten trees planted along Stevens Ave S.

3.       Screening that is at least three feet high and 60 percent opaque shall be provided along the entire frontage of both E Lake St and Stevens Ave S.

C.      Variance of drive aisle width.

Action: Approved the application to reduce the minimum drive aisle width from 22 feet to zero feet for those parking spaces on the 112 E Lake St site and from 22 feet to 20 feet for those parking spaces on the NICO Products property, subject to the following conditions:

1.       The existing railing on the 112 E Lake St property shall be removed and the same four-foot high decorative metal fence with landscaping shall be installed between the property line and the first parking space.

Action: The City Planning Commission recommended that the City Council approve the vacation of a part of the alley in Block 3, Boulevard Addition to Minneapolis, in the block bounded on the south by E Lake St, on the west by 1st Ave S, on the north by the Midtown Greenway and on the east by Stevens Ave S, subject to the retention of an easement for CenturyLink.

5.       1201 W Broadway, Ward 5

The City Planning Commission adopted staff findings for the applications by Kristian Olson.

A.      Conditional use permit.

Action: Approved the application for a telecommunication tower, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The applicant shall submit a letter from a licensed engineer stating that the tower has the structural integrity to withstand typical wind loads and inclement weather.

3.       The applicant shall provide landscaping and screening to the base of the tower and mechanical equipment as required by sections 535.70 and 535.540(3) of the zoning code.

4.       The chain-link fence used to screen the base of the telecommunications tower and mechanical equipment shall be vinyl-coated and shall not include barbed wire.

5.       The applicant shall plant three (3) deciduous, canopy trees on the site along Fremont Ave N. The canopy trees shall be capable of growing to at least fifty (50) feet in height. The trees shall be at least 3” caliper size at the time of installation. The tree species, installation and maintenance shall comply with sections 530.200 and 530.210 of the zoning code. CPED staff shall review the proposed canopy trees prior to issuing building permits.

6.       The proposed telecommunications tower shall be constructed of, or treated with, a corrosive resistant material and be painted light blue to blend in with the sky. All proposed antennas, supporting equipment and structural equipment upon which they are mounted shall be painted to match the tower.

7.       No portion of the mounting pipes shall extend above or below the antenna. Empty mounting pipes shall not be permitted. No antennas shall protrude above the tower.

8.       The visibility of cables and wires will be reduced whenever possible. Exposed cables will be painted to match the tower. Free-floating wires will only be permitted when no other concealment option is available.

The City Planning Commission adopted staff findings for the applications by Aeon Prospect Park, LLC.

A.      Rezoning.

Action: The City Planning Commission recommended that the City Council approve the application to rezone the property from I1 Light Industrial District to C3A Community Activity Center District.

B.      Conditional Use Permit to increase the maximum building height.

Action: Approved the application to increase the maximum building height from 4 stories, 56 feet to 5 stories, 63 feet, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.      Variance to decrease the minimum vehicle parking requirement.

Action: Approved the application for a variance to reduce the minimum vehicle parking requirement from 51 spaces to 37 spaces.

D.      Variance to decrease the minimum bicycle parking requirement.

Action: Approved the application for a variance to reduce the minimum bicycle parking requirement from 147 spaces to 88 spaces.

E.       Variance to the Pedestrian Oriented Overlay District standards.

Action: Approved the application for a variance to the Pedestrian Oriented Overlay District standards to allow a building placement greater than 8 feet from the property line along 30th Ave S and 4th St SE.

F.       Site Plan Review.

Action: Approved the application to construct a new 70 unit residential building, subject to the following conditions:

1.       All site improvements shall be completed by January 21st, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

8.       Zoning Code Text Amendment, Ward All

The City Planning Commission recommended that the City Council return the ordinance to amend Chapters 546, 547, 548, 549, and 551 Title 20 of the Minneapolis Code of Ordinances to the author.

A.      Text amendment.

Action: The City Planning Commission recommended that the City Council return the text amendment to allow flexibility to the residential dwelling unit occupancy regulations in the zoning code to the author.

9.       Van White Blvd Station Area Plan, Ward 5 and 7

A.      Station area plan.

Action: The City Planning Commission recommended that the City Council approve the Van White Memorial Boulevard Station Area Plan and amend the policy guidance into the City’s comprehensive plan update: Minneapolis 2040 recommending the following changes:

1.       Amend the description of the Urban Scale development district on page 79:

o   Supports medium-density development at three to four-story building heights. The Urban Scale development district is intended to provide transitional density between the Transit Scale development district and the Neighborhood Scale development district. This category is generally most appropriate in the middle of the station area.

2.       Amend the description of the Medium Density Residential development district on page 68:

o   Medium Density Residential: Areas that allow multi-family at 20-50 dwelling units per acre. The Medium Density Residential district is intended to provide transitional density between the Medium to High Density Residential district and the Low Density Residential district. This land use category is generally most appropriate at the edges and the middle of the station area.
