The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Tony Kriha of The Lander Group.

A.      Rezoning.

Recommended motion: Approve the petition to rezone the properties at 3752 Hiawatha Ave, 2922-2924 38th St E, and 3731-3805 29th Ave S for a planned unit development.

1.       The western portion of 3752 Hiawatha Ave, 2922 38th St E, the southern portion of 2924 38th St E, 3749-3757 29th Ave S, and 3805 29th Ave S from the C1 Neighborhood Commercial District to the C3A Community Activity Center District, retaining the PO Pedestrian Oriented Overlay District.

2.       3731 29th Ave S from the R5 Multiple-Family District to the C3A Community Activity Center District, retaining the PO Pedestrian Oriented Overlay District.

3.       3733-3745 29th Ave S from the R4 Multiple-Family District to the C3A Community Activity Center District, retaining the PO Pedestrian Oriented Overlay District.

B.      Conditional Use Permit for a Planned Unit Development.

Recommended motion: Approve the application to allow a planned unit development in the C3A Community Activity Center District, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The art feature shall be maintained in good order for the life of the principal structure. In addition, the art shall be valued at not less than one-fourth of one (1) percent of the capital cost of the principal structure

3.       The applicant shall submit a plaza plan that meets the requirements of section 535.800 and 535.810 of the zoning code.

4.       The applicant shall revise the site and landscaping plans so that the plaza includes a smooth, straight, unobstructed walkway at least four (4) feet in width between the southernmost bus bay and LRT platform.

5.       All final plans shall remove any visual references to fencing between the property line adjacent to 38th St E and the building.

6.       All site plans shall be revised to indicate the location of the water feature.

7.       A minimum of 126 linear feet of seating shall be provided within the plaza, including a minimum of 25 linear feet of fixed seats, a minimum of 25 linear feet of seats with backs, and a minimum of 32 linear feet of moveable chairs. At least two (2) different types of seating shall be provided and all seating shall be accessible and of appropriate ergonomic design.

8.       The applicant shall obtain encroachment permits for all encroachments within the public right-of-way.

9.       A minimum of three (3) trash receptacles and three (3) recycling receptacles shall be provided within the plaza.

10.   The plaza shall be maintained in good order by the property owner for the life of the plaza. Proper maintenance shall include, but not be limited to, snow and ice removal, annual maintenance of vegetation and green space and annual inspection and repair and/or replacement of furnishings. Minimum landscaping and seating requirements shall be maintained for the life of the plaza.

11.   The plaza shall be open to the public during daylight hours.

C.      Variance to reduce the minimum windows requirement.

Recommended motion: Deny the variance to reduce the minimum windows requirement from 40 percent to 9 percent in the PO Pedestrian Oriented Overlay District.

D.      Site Plan Review.

Recommended motion: Approve the application for a three-story commercial building, subject to the following conditions:

1.       All site improvements shall be completed by October 20, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall submit final lighting plan which demonstrates compliance with section 535.590 prior to the issuance of building permits.

4.       Lighting shall be provided at all building entrances to provide a minimum acceptable level of security.

5.       All signage requires a separate permit from CPED.

6.       At least one principal entrance to the ground floor retail space shall be defined by an architectural feature.

7.       The final elevations shall be updated to specify all exterior materials, including those underlying the art feature.

8.       The east elevation shall be revised to eliminate any blank, uninterrupted walls exceeding 25 feet in length.

9.       All ground floor windows facing a public street shall allow views into and out of the building between four (4) and seven (7) feet above the adjacent grade. Required nonresidential windows shall not be blocked by fixtures in the required window area, and the visible light transmittance of the windows shall be 0.6 or greater as required by section 530.120 of the zoning code.

10.   Each individual ground-level tenant shall be required to provide a minimum of 40 percent windows between two (2) and ten (10) feet above the adjacent grade for all elevations facing a public street.

11.   The final site and floor plans shall indicate the location of refuse, recycling, and compost containers, and all containers shall comply with the screening requirements of section 535.80.

12.   The final plans shall be revised to include at least one (1) long-term bicycle parking space as well as at least four (4) bicycle parking spaces within 50 feet of the entrance to the ground floor retail use.

E.       Preliminary/Final Plat.

Recommended motion: Approve the application for a preliminary and final plat to combine several underlying plats into one, and to create a new public street named 30th Ave S.

6.       3100 Lake Street Apartments, 3100 W Lake St, Ward 7

This item was continued from the August 14, 2017 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Jeff Dawson with 3100 MSP, LLC.

A.      Conditional use permit for a Planned Unit Development.

Recommended Motion: Approve the application to allow a modification to an existing Planned Unit Development, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       As required by section 527.120 of the zoning code, the development shall comply with the standards for underground parking, a reflective roof, a pet exercise area and a recycling storage area totaling a minimum of 15 points.

3.       There shall be at least two bollard-style lights in or immediately adjacent to the pet exercise area.

4.       There shall be at least one trash receptacle be installed near the pet exercise area.

5.       There shall be a continuous accessible walkway that leads from the public sidewalk along West Lake Street to the existing residential building on the site.

B.      Site plan review for a new 200-unit residential building.

Recommended Motion: Approve the application for a new 200-unit residential building, subject to the following conditions:

1.       All site improvements shall be completed by September 18, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       No more than 75 percent of the north elevation shall be clad in stucco.

4.       There shall be a continuous accessible walkway that leads from the public sidewalk along West Lake Street to the existing residential building on the site.

7.       Target Field Station Mixed Use Project, 505 6th Ave N, Ward 5

Chapter 535 Communication towers, antennas, and base units

 

The purpose of the amendment is to revise regulations for telecommunications facilities to bring the zoning code into conformance with recent changes in State legislation and to provide general updates in line with changing technology.

Recommended Motion: Approve the text amendment to revise regulations related to

telecommunications towers, antennas, and base units.

The purpose of the amendment is to revise the off-premise advertising requirements, related to the Downtown Entertainment Billboard District.

Recommended Motion: Approve the text amendment to enlarge the Downtown Entertainment Billboard District and remove the restrictions of City financing of billboards. Staff recommends returning amendments to Chapter 525 to the author.
